The case instituted by Hon Kunle Odidi led faction of the Labour Party state executive was came up on Tuesday at the Federal High court sitting in Akure.
The court granted the motion moved by Tolu Babaleye to issue and serve court process on the Labour Party and INEC in Abuja. no date has been fixed for hearing.
It will be recalled that following the resignation of Dr Olaiya Oni from the Labour party, (LP) Barrister Ogidan was picked by the governor, Dr Rahaman Mimiko a situation that spurred crisis in the party.
Hon Odidi and others felt the process of selection of the chairman was undemocratic and ordered the governor to rescind his decision. But in a swift reaction, the governor selected few members of the Labour party belonging to the order faction assembled them in Akure to ratify the appointment of Ogidan.
Odidi and the majority of the party members felt the action of the governor is challengable in the court of law. Hence, the decision to head for the federal high court to challenge what he termed undemocratic selection of Ogidan.
In a related development the case of Taju Falana versus the Labour Party and 60 others in relation to his unlawful exclusion from contesting in the primary election before last April general elections against Hon Abiodun Ogunbi also came up. The case was argued by Dr Tunji Abayomi leading three other lawyers. The case was adjourned till 15th of March 2012 for ruling.
Speaking with Hon Kunle Odidi after the case in Akure, he expressed optimism that he shall secure justice and bring the Labour Party back to the original dreams of the founders. “This is a trying period. Our party is passing through fire. In democracy, rule of law and due process must reign supreme. Thank God we have the judiciary that is ready to right the wrong in the system, democracy would have been history by now”, he said. |
